A BILL to amend article six, chapter thirty-three of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated
section twenty-three, relating to requiring insurers to
provide coverage for bodily injury and personal injury
resulting from employment discrimination or harassment.
Be it enacted by the Legislature of West Virginia:
That article six, chapter thirty-three of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
twenty-three, to read as follows:
ARTICLE 6. THE INSURANCE POLICY.
§33-6-23. Liability policies to cover injuries from employment
discrimination or harassment.
No insurance policy insuring against loss or damage through
legal liability for the bodily injury or death by accident of any
individual, or for damage to the property of any person, may
contain any condition, stipulation or requirement that excludes
bodily injury and personal injury resulting from employment
discrimination or harassment. Any such provision is void.
NOTE: The purpose of this bill is to require insurers to
insure for bodily injury and personal injury resulting from
employment discrimination or harassment.
